A West Bountiful man connected to the theft of two vehicles and a high-speed chase through Stansbury Park was sentenced to 90 days in jail and four years of probation in 3rd District Court Tuesday.
Simone Jr. Toko, 23, was pulled over in Erda on May 24 while driving a stolen Jeep Cherokee. Toko sped away, however, before the officer could approach the vehicle. As the officer initiated chase, he was followed by a Cadillac driven by Sione Vatuvei, 21, of Salt Lake City.
Toko eventually abandoned the Jeep in Stansbury Park and hijacked a Chevy Suburban with a male inside. He told the driver he had a gun and ordered him to drive.
The Suburban and the Cadillac then sped off in separate directions, each being pursued by law enforcement.
The owner of the Suburban fled from his vehicle at his first opportunity, and Toko then slid over into the driver’s seat and continued driving for a short time before eventually fleeing the vehicle and continuing on foot.
Approximately two hours later, police caught up with Toko and took him into custody.
Vatuvei was arrested after crashing the Cadallic into a vinyl fence on Village Boulevard.
Toko was originally charged with first-degree felony aggravated robbery, first-degree felony aggravated kidnapping, second-degree felony theft by receiving stolen property, and two counts of failure to stop at the command of police — one a third-degree felony and the other a class A misdemeanor.
Toko, however, pled guilty to amended charges of second-degree felony robbery and third-degree felony failure to stop at the command of police as part of a plea deal.
Toko’s defense attorney, Chelsea Koch, stated for the record that a subsequent investigation revealed that Toko did not have a gun when he hijacked the Suburban.
Judge Stephen Henriod said the facts of the case still left him troubled, and he felt like Toko had already burned bridges with potential organizations that could provide treatment because of his previous criminal history as a juvenile.
Henriod sentenced Toko to one to 15 years in prison on the aggravated-robbery charge and zero to five years in prison on the failure-to-stop-at-the command-of-police charge. He then suspended that prison time in lieu of an additional 90 days at the Tooele County Jail and 48 months of probation. Toko was also order to pay a $1,500 fine and full restitution.
“If you fail to do anything [required during the probation period] you will go to prison,” Henriod said. “I’m giving you a chance, but you can’t mess up again.”
Vatuvei pled guilty to third-degree felony failure to stop at the command of police in September. He was scheduled to appear for sentencing Tuesday, but he was booked into the Salt Lake County Metro Jail that morning on first-degree felony aggravated robbery charges. The sentencing hearing was reset to Nov. 3.
