The Grantsville City Council and Mayor Brent Marshall met in a closed session with their attorney Wednesday night and emerged ready to take the Grantsville vs. Tooele lawsuit to trial.

“We are pleased with the state Supreme Court decision and plan to proceed to trial,” said Scott Lilja, of the Salt Lake City-based firm of VanCott, Bagley, Cornwall and McCarthy, which is representing Grantsville in the lawsuit.

Last Friday, the Supreme Court overturned a 3rd District Court decision to dismiss the case in 2007, clearing the way for a jury trial in the lower court. The nine-year-old case centers around the sale of former Army property that became the Utah Industrial Depot, as well as subsequent economic development efforts by Tooele City.

Lilja said he does not have a time frame for the trial, but needs to meet with Judge Stephen Henriod of the 3rd District Court to find out how the judge wants to proceed.

“We will go to trial and accept the decision of the jury,” said Marshall.

Tooele City officials could not be reached for comment.

More litigation for the tools in our city government. Is it really shocking that the City would waste more money on more litigation? Has anyone in the City admitted a mistake in the last 10 years? This is typical. Roger Baker is an embarrassment and he needs to start doing what is best for the City's residents...not what's best for him. The City Council needs to be thrown out and replaced with people who know how the real world works.
